Soraya, one of the organisers of the party where the former deputy Íñigo Errejón allegedly sexually assaulted Elisa Mouliaá, stated on Friday before the judge that the actress "told her that what happened" with the former leader "was not a crime" at the time of the events.

Legal sources explained to Europa Press that in her testimony as a witness —via videoconference from Australia— Soraya indicated that Mouliaá made this statement in an audio that has been requested by the investigating judge, Adolfo Carretero.

The actress reportedly told her that she eventually reported him because, after learning about similar cases, she believed the actions could be punishable under the 'only yes means yes' law and felt a "moral duty" to do so "for altruistic reasons".

Before the magistrate, the witness also noted that the actress is someone who sometimes "embellishes and fabricates things." Although she said she has "no animosity" towards her, she explained that they stopped speaking because she disliked this supposedly imaginative behaviour.

"SHE WAS NOT QUITE AFFECTED"

The witness claimed that Mouliaá "was not quite affected" by alcohol, but "like everyone when they have a few drinks," aligning with the testimony of another witness proposed by the actress, Fernando, who in March stated he noticed no strange behaviour at the party and did not see her drunk or approach him to say she was uncomfortable.

Regarding what happened inside the room, Soraya indicated that Mouliaá told her Errejón "came on strong, very quickly," was "a bit sleazy," and she did not want to get to know him further as she felt disappointed by his behaviour.

Mouliaá also expressed, according to her, that she did not want to do anything in that house because she wanted to go "slower" and that Errejón —whom the witness said she did not see drunk— kissed and groped her.

And when Mouliaá "voluntarily" left the house, she appeared normal, noting that the doorknobs of the rooms do not have locks, as the complainant accuses the former deputy of forcing her into the room and locking the door.

"WHAT'S THE PLAN?"

On the same Friday, the judge also took a statement from the other organiser of the party, Borja, who also resides in Australia. Both reportedly broke ties with Mouliaá when she divorced her husband, who was their friend.

Borja recounted that he contacted Errejón via email after learning of the complaint because he found the accusations unfair and added that they have had more conversations.

"What's the plan with the trial?" he admitted to asking the former deputy, inquiring about "practical information on what was happening."

Regarding Mouliaá, the witness stated that he did not see her very affected that night either and would have noticed if Errejón had grabbed her arm in the hallway. "I didn't see anything out of the ordinary," he remarked, also noting that there were no locks in the house.

A third witness present at the party, Hugo, noted that he did not see the actress "particularly drunk," did not recall seeing her with a drink in hand, and saw them "normally" when they left, adding that Mouliaá sent him a message that he ignored.

Also summoned as witnesses were the two taxi drivers who took Errejón and Mouliaá on the night of the events —September 2021—, who did not attend after sending written statements to the court saying, one, he did not remember anything and the other, he was not able to testify.
