Man Steals Friend's Phone and Sends Intimate Photos to Himself

Police Arrest Suspect for Breach of Privacy and Disclosure of Secrets

Officers from the National Police have arrested a man in Benidorm who took advantage of a friend's distraction at a party to access her mobile phone and seize intimate photographs.

The woman filed a complaint at the Benidorm Police Station, stating that an acquaintance, with whom she attended a party at a house in La Nucía, accessed her phone without permission during a moment of inattention and sent intimate photos to his own phone.

Right to Privacy Protected by Law

The right to privacy is enshrined in Article 18 of the Spanish Constitution and is one of the fundamental rights protected by the Magna Carta. Breaching this right is covered under Article 197 of the Penal Code, and committing such an offence could result in a prison sentence of one to four years, as it involves violating a fundamental right.

In response to these events, officers from this station's Economic and Technological Crime Group launched an investigation to verify the reported facts and identify, locate, and arrest the alleged perpetrator.

Following initial inquiries, officers confirmed that the suspect had accessed the victim's mobile device and sent two intimate photographs of her to his own phone via a messaging application. Additionally, during the investigation, officers took a statement from a witness who corroborated the victim's account in her complaint.

The suspect, a 39-year-old Spanish national, was arrested for the alleged commission of a crime of discovery and disclosure of secrets. All police proceedings were forwarded to the duty court in Benidorm.

To avoid falling victim to such crimes, the National Police advise not leaving electronic devices containing sensitive, intimate, or potentially compromising information in the hands or reach of people who are not fully trusted, as it could endanger your security or damage your image if it falls into the wrong hands.
