The Provincial Council Defends the Legality of Its Media Contract: 'Endorsed by the Courts on Four Occasions Since 2022'

The Administrative Litigation Courts and the Central Administrative Court of Contractual Appeals have rejected all Compromís' claims in the last two legislatures

The governing team of the Alicante Provincial Council has defended the 'legality' of its advertising contracts and has 'categorically' denied the existence of a scheme favouring media outlets through campaigns funded with public money, following the Anti-Corruption Prosecutor's Office opening proceedings based on a Compromís complaint regarding awards amounting to several million euros.

The Deputy for Culture and head of the Contracting area in the provincial institution, Juan de Dios Navarro, has defended the 'legality' of the contract for planning and purchasing advertising space in the media of this institution, 'which has been endorsed on four occasions by different courts in the province since 2022,' that is, in the last two legislatures - the previous one, presided over by Carlos Mazón, and the current one, with Toni Pérez at the helm.

'The contract fully complies with current legislation, and this has been determined by the courts of justice on the four occasions Compromís has reported it in the last three years: two with rulings from the Administrative Litigation Court and two with resolutions from the Special Contracting Court,' Navarro defended in a statement.

Furthermore, the deputy responsible for Contracting expressed 'surprise' that the Compromís spokesperson in the provincial institution and complainant, Ximo Perles, 'now turns to the Prosecutor's Office after the courts have told him on four occasions that he is wrong, with very harsh arguments in these rulings regarding his conduct and the little support these complaints have.'

He also maintains that 'in the latest resolution by the Central Administrative Court of Contractual Appeals, Perles was ordered to pay 1,000 euros for recklessness in filing the appeal.'

'None have filed a complaint'

Similarly, Navarro argued that 'none' of the companies that bid for this contract and were not awarded 'have filed any type of complaint or lawsuit in the two tenders that have been made, with up to ten companies participating in each.'

The provincial official has 'categorically' denied that there is, as Compromís has claimed, a 'scheme' to use public money to favour certain media outlets.

'Only in the last year, the Provincial Council has placed advertising campaigns, through the awarded company, in 125 media outlets of all formats and sizes, all of them with territorial and social presence in the province of Alicante,' he maintained.

'Objective criteria'

In this regard, he asserted that 'the selection of these media when placing the advertising is based on objective criteria of dissemination, audience, reach, and penetration, as stipulated by Law 12/2018, of 24 May, on institutional advertising.'

On the other hand, Navarro also rejects and criticises the 'accusations made by Ximo Perles against Provincial Council officials,' after the Compromís spokesperson referred to the 'possible involvement' of officials and political leaders in the 'manipulation of the awarding process.'

'It is very serious to directly accuse workers of this institution of participating in a fraudulent scheme, as Mr. Perles has suggested, who knows well the hours these public employees are dedicating, beyond their ordinary tasks, to respond with professionalism and speed to all the information requests he makes as a deputy, and they are not few,' stated the deputy responsible for Contracting.
