Residents of the northern coastline of Dénia feared this day would come. The Ministry for Ecological Transition and Demographic Challenge has approved the demarcation of a 3,500-metre stretch of Les Deveses beach. The specific area lies between the mouth of the Molinell River and Riu Xinxilla Street. This is outlined in the Ministerial Order of 20 December 2024, published in the Official State Gazette (BOE) this Wednesday. According to municipal estimates, more than 40 homes will be affected by this measure.
The ministry has heeded one of the council's requests, considering the consolidated land study conducted by Dénia. Consequently, the protection zone has been reduced to 20 metres in some areas, while remaining at 100 in others. The text in the BOE states that "the servitude protection zone has been excluded (maintaining the legal minimum of 20 metres) for buildings in this situation, similar to cases where progressive reductions are applied to avoid urban compensation," referring to those on land considered consolidated when the Coastal Law of 1988 was enacted.

However, the ministerial resolution highlights that "common elements of these plots (gardens, pools, among others) would not be subject to this reduction, with these common areas being applied a width as harmonious as possible with that of adjacent plots - whether 100 metres, 20 or intermediate between both."
The Councillor for Territory of Dénia, Maria Josep Ripoll, acknowledged that these parameters for the final demarcation of the northern coastline represent "a mixed blessing." She notes that the positive aspect is that the consolidated study they conducted was considered and that "a large part" of the protection servitude has been reduced to 20 metres, but they would have preferred a lesser impact.
In this regard, Ripoll highlights that compared to the more than 100 homes, according to her calculations, initially affected in that section, which was "outrageous," now only 26 will be fully affected and about 15 partially.
Despite this decision by the ministry, the council intends to continue the fight, assures the councillor. "We will continue to advocate for an amendment to the Coastal Law and for the execution of the two pending regeneration projects." In her view, it is necessary to include financial compensation for the owners of homes that were built under the legal framework of the time and now find themselves no longer owning their properties.
Moreover, this is only the first of the demarcation files that Dénia had open. Two more remain unresolved, affecting other sections of the coastline.
