JUPOL, the leading union within the National Police, has achieved another legal victory in defending the labour rights of the force's officers. The Superior Court of Justice of the Valencian Community (TSJCV) has issued a favourable ruling recognising the right of eight officers assigned to the Scientific Police Brigade at the Elche Local Police Station to receive the same General Specific Allowance (CEG) as their colleagues with the rank of official, as they perform the same duties.
The ruling 397/2025, issued on May 28, nullifies the Police Directorate General's denial and mandates the payment of the CEG differences to the appellants for the past four years, along with legal interest, as stated by JUPOL. The court decision argues that the differentiated economic treatment lacks objective justification and violates the constitutional principle of equality.
Furthermore, it affects positions in various specialities, Specific Merit Competition posts, where they share the same position and post in the Job Catalogue as "basic scale specialist" without distinguishing between first and second category.
David García, JUPOL's provincial secretary in Alicante, praised the court's decision as "one more in the wave of favourable rulings beginning to arrive in the province, recognising what is just: equal pay for equal work." García emphasised that these rulings "not only affect Scientific Police colleagues but also those assigned to other units such as Telecommunications, Armament and Shooting, Special Systems, Aerial Media, or Road Training."
The union, "a leader in the fight for salary equalisation," noted that this ruling "is just the beginning of a series of judicial decisions in the same vein," recognising that many national police officers have been performing identical functions to those of higher-ranking colleagues without receiving the same pay. "This salary discrimination is unacceptable in a State governed by the rule of law and violates the principle of equality that should govern all employment relationships, especially within the public service," the union spokesperson stressed.
The lawsuit was processed by JUPOL's legal services in Alicante, through the Sánchez Navarro Abogados law firm, and is part of a legal strategy that the union will continue to promote in all provinces where similar situations occur. This ruling by the Superior Court of Justice of the Valencian Community is not yet applicable to other autonomous communities, the union clarifies, although it adds that JUPOL's legal services "are trying."
"We at JUPOL demand that the Police Directorate General does not appeal this ruling and immediately applies the criteria established by the courts, extending this pay equalisation to all affected officers without the need for further legal action," the organisation concludes in a statement.
