Iustitia Europa confirmed on Friday at the High Court of Justice of the Valencian Community (TSJCV) the lawsuit filed against the President of the Generalitat, Carlos Mazón, considering it "crucial" that his absence at the Integrated Operational Coordination Centre (Cecopi) on October 29 may have led to the late and inadequate alert regarding the DANA. Therefore, they assert that "judicial explanations must be provided."
This was expressed to the media outside the TSJCV by the president of the entity, Luis María Pardo, who emphasized that their organization has confirmed this lawsuit for the crimes of negligent homicide, injuries, failure to provide assistance, and omission of duty.
"We believe that Mazón's absence on the day of the events, appearing when the cities were practically, if not already flooded, at the onset of flooding, may have been crucial in failing to alert the population. Political responsibilities are currently being deliberated, and judicial explanations must be provided," he stated.
In this regard, Luis María Pardo indicated that Iustitia Europa wants the TSJCV "to open a criminal investigation, to investigate if there are rational indications of criminality and, if there are, to initiate a criminal proceeding against the president and all those responsible for this tragic event."
The entity has filed the lawsuit exclusively against the President of the Generalitat at the TSJCV, just as they have against President Pedro Sánchez; the Minister of Justice, Fernando Grande-Marlaska; and the Minister of Ecological Transition, Teresa Ribera, at the Supreme Court.
"Each of them in the competent court," he specified, adding that they approached the TSJCV because "in the case of Mazón, the competent court due to his immunity is this one." "In the other lawsuits, we have made a note of all those who are criminally responsible," he highlighted.
The president of this entity believes that the lawsuit "may succeed." "At the very least, there must be a criminal investigation to verify and establish what occurred at Cecopi on October 29, both on the part of President Mazón and the ministries, as well as what was decided there and whether his absence determined that the alert to the civilian population was given late and inadequately," he criticized.
"Why was the alert issued after eight o'clock? Was it issued after those hours due to President Mazón's absence? Why didn't Teresa Ribera inform him? Why didn't Marlaska call?" he questioned, asserting that "all this must be investigated" in the various judicial bodies.
Furthermore, the president of Iustitia Europa considered that the fact that those sued have immunity "initially does not complicate" the judicial process and that they "trust" the courts to "investigate and decide if there are indications of criminality."
"Certainly, we have tried to provide a framework of the events, how they occurred, the possible responsibilities, and the crimes we charge not only against Mazón but also against Sánchez, Marlaska, and Ribera," he stated.
