The General Court of the European Union (GCEU) confirmed on Wednesday the €320 million fine on Poland for legislative reforms that undermine judicial independence, carried out by the government of Mateusz Morawiecki and his Law and Justice party (PiS, in Polish). The sum corresponds to a coercive fine imposed by the Court of Justice following a procedure initiated by the European Commission for Warsaw's non-compliance with European law. The ruling can be appealed by Poland to the ECJ, the highest court based in Luxembourg.
The tug-of-war between Brussels and Warsaw was constant during the Morawiecki era regarding judicial independence, with numerous cases open and hundreds of millions in fines against Poland. In this particular case, the Court of Justice obliged the country to suspend the application of certain national provisions challenged by the Commission, and by not respecting these interim measures, Poland was ordered to pay the Commission a daily coercive fine of one million euros, an amount reduced to 500,000 euros daily from April 21, 2023.
As Poland did not pay the daily coercive fines, the Commission periodically proceeded to collect them by offsetting various credits of the member state against the Union. Poland then filed an appeal with the General Court seeking the annulment of a total of six compensation decisions corresponding to the period between July 15, 2022, and June 4, 2023. The amounts collected by the Commission amount to approximately €320 million.
Sources from the Polish government stated on Wednesday that they are still analysing the ruling to decide whether to appeal this decision of the European judiciary.
