The Ministry of Equality, through the Women's Institute, has submitted a legal report to the State Attorney's Office concerning the 334 complaints received by the Women's Image Observatory (OIM) between November 29 and December 31, 2024. These complaints pertain to the commercial promotion of surrogacy on websites and social media. With this report, the State Attorney's Office can initiate the necessary legal actions.
The Organic Law 1/2023, dated February 28, on sexual and reproductive health and voluntary termination of pregnancy, explicitly prohibits the commercial promotion of surrogacy. Furthermore, this law urges public administrations to initiate legal proceedings aimed at declaring the illegality and cessation of advertising that promotes commercial practices for surrogacy.
The report includes an analysis of publications by the eight agencies based in Spain, highlighting the various communicative strategies these businesses use to attract potential clients. These range from blog interviews that disguise the violence this practice poses to women's health to the idealisation of so-called 'gestational mothers'.
The director of the Women's Institute, Cristina Hernández, has stated that "renting a woman's womb is a detestable practice in any society that understands women's rights as human rights. Women's bodies are neither for sale nor for rent."
"Our duty is to act against these types of messages, which are heavily laden with sexism, classism, and racism. In them, women are also rendered invisible and are only referred to as potential consumers of a product," Hernández added. "Linguistic euphemisms cannot hide a situation of violence and reproductive exploitation of women due to their vulnerability," she noted.
