Elche Mayor, Pablo Ruz, has welcomed the ruling by the Valencian Community's High Court of Justice (TSJCV), which considers that the Germanías Promenade Cross does not violate the Historical Memory Law, as it lacks Francoist significance having been redefined.
The fourth section of the Valencian Community's High Court of Justice rejects the inclusion of redefined crosses or those lacking any inscription or expression aligned with commemoration, exaltation, or glorification in the Civil War and dictatorship vestiges catalogue approved in 2022 by the Botànic Government.
The court cited, in its resolution, the specific case of the cross at the intersection of Doctor Gadea Avenue with Maisonnave in Alicante, which bears the inscription '1936-1940 to all men and women who died defending their ideals'; in Elche, the Germanías cross (without text); in Castelló, the Ribalta Park cross, without text; in Herbés, the cross in the Town Square (or church), also without inscription; and in Morella, the iron cross at Querol port, similarly lacking text.
"It is a ruling we receive with great satisfaction, which we deeply respect and find very positive," stated Pablo Ruz in a statement, adding that the space housing the monument "is designed for gathering and celebration, to progress and build."
The TSJCV's decision comes three weeks after the inauguration of the Garden of Concord with a large event recognizing the transition, where the first democratic mayor of Elche, Ramón Pastor, was honored with a monolith dedicated to him, the council notes.
