The Urban Planning Department of Alicante City Council is seeking ways to comply with the court ruling that allows the resumption of construction at the private hospital in Vistahermosa. Government co-spokesperson Manuel Villar explained in a press conference following the Government Board meeting that the company could commence work at any time.
However, it is not yet entirely clear how to ensure that only those works affecting the two floors covered by the granted license, which the court has allowed to resume, will proceed. Villar emphasized that the department is studying "which works can be isolated and are covered by the license, and which are partially affected and how to act in these cases from Urban Planning."
The councillor noted that although the company can restart work at any moment, they will wait for Urban Planning's criteria to avoid another halt. The council acknowledges that they are still considering the possibility of appealing this ruling. Villar insisted that even in this case, the works would have to continue.

Regarding whether, once the works on the two licensed floors are completed, the opening will be allowed, the councillor stressed that for now, it is only clear that "the judge has said that the works on two floors can continue, for the opening, we will have to see."
The judicial resolution, accessed by TodoAlicante, overturns the Urban Planning Department's decree to completely halt the works. The company responsible for the clinical centre's construction appealed this decision, and initially, the court has ruled in their favour.
It was on September 13, 2024, when the City Council ordered the immediate halt of works in progress for "not conforming to the granted license," due to an increase of two floors beyond the permit and one floor above the maximum height allowed by current planning. This is the resolution under appeal.
The ruling explains that "the execution of the appealed resolution is suspended, allowing the continuation of works with a valid license and not affected by the urban legality restoration procedure initiated on August 12, 2024."
In this regard, Villar emphasized that the halt of construction on this private hospital "must be limited to issues outside the license." That is what "we will evidently respect," he assessed.
It is now, following the court ruling in favour of the company, that the Urban Planning Department must "verify" which actions "could be considered" to resume works, as some "can continue individually" while others affect areas not covered by the license.
"It is a matter to be resolved," maintained Villar, who insisted that the City Council will "respect" the judicial ruling while initiating processes to see "how to proceed with its compliance."
