The National Commission of Markets and Competition (CNMC) has fined Endesa Energía and Naturgy Iberia a total of €1.2 million. This amount was reduced to €840,000 as both companies made the payment within the voluntary period, for omitting relevant information for consumers in their bills, the organisation reported.
Specifically, the regulator, led by Cani Fernández, imposed €600,000 on each supplier, the maximum fine for minor infractions, considering the impact on consumers over an extended period.
However, in the case of Endesa, the penalty was reduced by 20% to €480,000, and for Naturgy by 40% to €360,000, as both companies made the payment within the voluntary period.
Electric companies are required to include a minimum content in their bills, such as a QR code/link to the CNMC's gas and electricity offer comparator.
The investigation by the regulator occurred after two individuals reported receiving bills without the required minimum content. The instruction of the files confirms that Endesa Energía included incorrectly parameterised QR codes/links and that Naturgy Iberia omitted the QR code/link to the comparator in some of its bills.
Scanning the QR code on the bill allows the customer to view their own consumption data and compare whether there are more or less economical offers in the market. Additionally, it allows access to 'Understand your bill', another CNMC tool that explains their contract and each charge on the receipt.
Failing to meet the required information standards in electric bills constitutes a minor infraction of Article 66.5 of the Electricity Sector Law.
Against these resolutions, an administrative contentious appeal can be filed before the National Court within two months from the day following its notification.
