The High Court of Justice of Catalonia (TSJC) has overturned the four-and-a-half-year prison sentence of footballer Daniel Alves for sexual assault on a young woman at the Sutton nightclub in Barcelona on the night of December 30, 2022, and has acquitted the footballer.
The appeals section of the Civil and Criminal Chamber of the TSJC has thus nullified the February 2024 sentence of the Barcelona Court.
The court unanimously upheld the appeal filed by the footballer's defense and dismissed those of the Public Prosecutor's Office, which sought to increase the sentence to 9 years in prison, and the private prosecution, which requested an increase to 12 years.
The ruling, which was notified this Friday, indicates a lack of reliability in the complainant's testimony and specifies that due to "insufficient evidence," it agrees to revoke the sentence, issue an acquittal, and nullify the precautionary measures adopted.
