With Easter just around the corner, many are planning road trips across Europe. However, amidst the excitement of travel, there's something important you must not forget: traffic fines. Did you know what happens if you receive a fine outside Spain? The most common violations include speeding, illegal parking, and ignoring traffic lights and signs. Danielle Rivero reminds us that, even when travelling, it's crucial to adhere to local regulations, as authorities can impose penalties similar to those in Spain.
Thanks to Directive 2011/82/EU, EU countries share information about traffic violations committed by foreign drivers. This means that if you are fined in another European Union country, you could receive the fine at your home in Spain, even if you are not a resident in that country, according to Pyramid Consulting.
Once you commit an offence, local authorities can send the fine to your home, thanks to the information exchange system between EU countries. The notification of the penalty will include details of the offence committed, the amount of the fine, the deadline for payment or for contesting the fine, and the available payment methods.
It is essential to verify that the personal data in the notification is correct, and if you do not receive the fine, ensure that the authorities of the issuing country have your updated address.
When you receive traffic fines, you will have several options. The simplest option is to pay within the indicated period. Some countries offer discounts if paid promptly, so make sure to do so on time. If you believe the penalty is unjust, you can contest it by following the legal process of the country where it was issued. Be mindful of the deadlines to avoid losing your right to appeal. Or seek legal assistance: If you have difficulties with the language or the process, or if the fine amount is substantial, it is advisable to seek specialised legal advice.
What happens if you don't pay the fine? Non-payment of a fine can lead to serious consequences, such as increased penalties, administrative surcharges, and legal issues. Additionally, some countries have agreements to collect fines imposed in other EU member states, which could result in additional problems at the national level. Pyramid Consulting warns that not all EU countries have agreements with recovery agencies, which sometimes impose excessive surcharges. Therefore, it is always advisable to have the support of a legal team specialised in European traffic.
Although an unpaid fine will not prevent you from entering the country that fined you, authorities may initiate legal proceedings if you have several unpaid or contested fines. In extreme cases, they could impound your vehicle until the matter is resolved.
