Andalusia Challenges Migrant Minors Distribution Decree at Constitutional Court Over 'Competence Invasion'

This announcement follows a similar decision by Castilla-La Mancha's President, Emiliano García Page, to challenge the decree.

Andalusia's Regional Government has decided in its meeting on Wednesday, June 11, to file a constitutional challenge against the Constitutional Court (CC) regarding Decree-Law 2/2025, dated March 18, which mandates the distribution of migrant minors among autonomous communities, arguing that it constitutes a 'competence invasion' by the central government.

This was announced by Carolina España, the Minister of Economy, Finance and European Funds and spokesperson for the Andalusian Government (PP-A), during the press conference following the weekly meeting of the Andalusian Executive, where she revealed the challenge against Decree-Law 2/2025, which approves urgent measures to ensure the superior interest of children and adolescents in extraordinary migratory contingency situations.

The spokesperson criticised the government's decision to distribute minors 'without dialogue and negotiation' with the autonomous communities, which 'are ultimately the ones truly affected,' she emphasised.

The Minister stated that 'Andalusia is a land of solidarity and welcome, but we cannot take responsibility for minors at the whim of the government, especially without the necessary financial resources to care for these minors as they truly deserve.'

In this regard, the spokesperson argued that there is a 'lack of financial resources' and 'competence invasion' by the government, and 'for this reason,' the Andalusian Government has decided to challenge the decree at the Constitutional Court, 'appealing to Article 86.1 of the Constitution and Article 61.3 of the Statute of Autonomy of Andalusia.'
