Alicante City Council Must Proceed with Macro-Deposits License Despite Constitutional Appeal

Cutanda reaffirms that "the main idea of this government team is that they are not installed, and that is what we are working on"

The spokesperson for the government team, Cristina Cutanda, has reaffirmed the City Council's commitment to ensuring that the macro-deposits "are not installed in the port, and that is what we are working on." The councillor reiterated the words of the mayor, Luis Barcala, last Thursday when he explained that the council would take the case to the Constitutional Court (CC)

regarding the ruling that supports the environmental license.

However, despite this appeal, it does not halt the processing of the license for the company XC Business 90, which can continue obtaining permits as long as there is no contrary ruling.

The mayor proposed last Thursday the possibility of opening negotiations to prevent the installation of the macro-deposits. Although no specific date has been set yet, councillor Cristina Cutanda has stated that they are waiting for XC Business 90 to contact the council to negotiate. In this case, the mayor, Luis Barcala, stated last Thursday that any agreement would require a 100% renunciation of the installation of these containers.

Appeal to the CC

Mayor Luis Barcala and the president of the Port Authority, Luis Rodríguez, have analysed a new joint strategy following the inadmissibility in the Superior Court of Justice (SCJ) of the Community of the municipal appeal requesting annulment against the authorization of the macro-deposits.

Thus, this Thursday, they announced the filing of an appeal before the CC. The City Council and the Port Authority are joining forces in a joint strategy that they will take to the Constitutional Court to prevent the installation of this storage plant in the city.

The judicial route "remains open," highlighted Barcala while announcing that the City Council is finalizing the submission - "already planned from the outset" - of an appeal to the Constitutional Court against

the inadmissibility of the one already filed before the SCJ.

"Under no circumstances will we accept the installation of macro-deposits that neither the city of Alicante nor the Port wants," Barcala emphasized this Wednesday. "No one can force us to have facilities that are overwhelmingly rejected by the public and the Authority itself, and we are working together with the Port to coordinate and promote alternative actions," he insisted.

the TSJ resolution, the mayor explained that "the only thing it enables for the company promoting the deposits is the environmental license, but the relevant construction and activity licenses, among other procedures, would still be pending, so there is still a long way to go before it can be assumed that this fuel storage plant will be installed in the Port."

The mayor has also addressed the company promoting the macro-deposits, XC Business 90, urging them "to contact the City Council, provided they are willing to renounce 100% the installation of that fuel storage plant in the Port of Alicante."
