Alicante City Council Files Nullity Incident Against Port Megadepots Ruling

The council seeks to overturn the previous TSJ ruling to prevent the installation of six of these structures

Alicante City Council has filed a nullity incident with the Superior Court of Justice of the Valencian Community (TSJCV) regarding the ruling on the fuel megadepots that the company XC Business 90 plans to construct in the port of Alicante.

The council processed the appeal this Thursday, following the Supreme Court's (TS) decision last December to dismiss the City Council's appeal against the TSJCV ruling, which in April of the same year granted the company a license through positive administrative silence. At that time, the mayor expressed his "utmost respect for judicial decisions, as it cannot be otherwise, but we cannot agree with it because I believe the appeal prepared by the municipal legal services was very well-founded."

Last Tuesday, January 21, the co-spokesperson of the government team, Manuel Villar, explained in the press conference following the Government Board meeting that the City Council planned to request the nullity during this week, within the deadline that ends on January 24.

The council has not disclosed the details of this appeal and states that in the coming days, once the TSJ receives it, they will inform about its content. In this way, the local government takes another step to prevent the installation of these megadepots, which is also opposed by the Alicante Port Authority (APA). Mayor Luis Barcala has already stated that he will "exhaust" all possibilities to prevent their location there.
